Terms of Use
Effective October 1, 2026
These Terms of Use (“Terms”) govern use of fapbric.com and its landing pages, assessment, forms and website demos (the “site”), operated by Fapbric Technology Solutions, LLC (“Fapbric,” “we,” “us”). When we present these Terms for acceptance and you accept them, you agree to be bound by them. If you do not agree, do not use a feature that requires acceptance.
You must be at least 18 and able to enter into a binding agreement to submit an inquiry, book a call or use a demo. If you accept these Terms on behalf of a business, you represent that you have authority to do so.
Our Privacy Policy explains how we handle personal information. Accepting these Terms does not provide consent for advertising tracking, call recording or automated marketing contact where separate consent is required.
1. Website information and service agreements
The site describes our services, standard offers and examples. Submitting a form, booking a call or using a demo does not purchase services or create a service engagement.
Services require a separate written agreement or quote accepted by both you and Fapbric. That agreement sets the scope, fees, schedule and other terms and controls over these Terms and general website descriptions for that engagement.
Published prices apply to the scope and conditions shown with the relevant offer. Work outside that scope is quoted separately before you commit. We may change published offers prospectively, but a website change does not alter an agreement already accepted by both parties. Any stated quote-validity period continues to apply.
Unless a separate offer expressly says otherwise, introductory calls, reviews and demos are free and do not require you to purchase services. Either party may decide not to proceed with an engagement.
2. Third-party services and costs
Some implementations use third-party phone, AI, messaging, hosting or other services. For our standard AI front desk implementation, the phone and AI services run in accounts the client owns, and the client pays those providers directly. Different arrangements must be agreed in writing.
Third-party charges are separate from Fapbric’s fees unless an offer or signed agreement expressly includes them. Provider terms, usage limits and prices apply to their services. Any usage estimates on our site are illustrations based on stated assumptions and available rates, not guaranteed bills or binding provider quotes. Actual charges depend on usage, configuration and provider pricing.
3. AI, demonstrations and results
AI and automation can produce incorrect or incomplete information and can fail. Important decisions require appropriate human review. Judgment stays with the person accountable for it. Website demos are for evaluation and are not emergency services or a substitute for legal, medical, financial or other professional advice.
Sample conversations, screens and scenarios identified as examples are illustrations, not promises of a specific outcome. Images identified as AI-generated are illustrations. Actual case studies or customer statements, when identified as such, describe the circumstances stated with them.
Results vary with the business, implementation and other circumstances. Unless expressly promised in a separate written agreement, we do not guarantee a particular number of calls, leads, bookings, sales, savings or revenue. This section does not change express obligations in a service agreement or excuse inaccurate or misleading statements.
4. Responsibilities for client implementations
A separate service agreement defines each party’s responsibilities for an implementation. Clients are responsible for their business decisions and for notices, permissions and consents that applicable law requires them to obtain, including for customer communications and call recording. Fapbric remains responsible for its own obligations under the agreement and applicable law.
We do not provide legal advice. Client ownership of third-party accounts does not, by itself, resolve either party’s legal responsibilities.
5. Using the site and submitting information
Do not:
- use the site unlawfully or impersonate someone;
- knowingly submit false information or information you are not authorized to provide;
- send spam, malicious code or abusive automated submissions;
- attempt unauthorized access, bypass access controls, interfere with the site or expose other people’s information; or
- copy, extract or reuse site materials in a way that infringes intellectual property rights or violates applicable law.
Use fictional details in demos. Do not submit passwords, financial-account details, health information, confidential customer records or other sensitive information through general forms or demos. Contact us first if a proposed project requires such information.
You retain your rights in materials you submit. You give us permission to use them as reasonably needed to evaluate and respond to your request or provide an agreed service, subject to our Privacy Policy and any applicable confidentiality or service agreement. Submitting material does not give us permission to publish it as a testimonial or case study.
We may restrict access to address misuse, security threats or legal requirements. This does not alter obligations under a separate service agreement.
6. Communications
When you contact us or make a booking, we may respond using the contact details you provide and send communications related to your request. We may also send business marketing email as described in our Privacy Policy. You can unsubscribe from marketing email or ask us to stop marketing calls.
We do not send marketing text messages. Accepting these Terms, submitting a form or booking a call does not by itself authorize automated, prerecorded or AI-generated marketing calls, or consent to recording a call.
We may provide routine communications electronically, including by email. You can keep copies for your records. Any legally required consent to electronic delivery of particular records will be obtained separately where necessary.
7. Intellectual property
Fapbric and its licensors retain the rights they hold in the site’s content, branding, designs and code, to the extent those materials are protected by law. Third-party names and marks belong to their respective owners.
You may view the site, share links and make reasonable copies for internal business evaluation. This permission does not authorize misleading use of our name or logo or other infringement. Any separate license stated for particular material continues to apply. Nothing in these Terms limits uses permitted by applicable law.
8. Feedback
If you voluntarily provide nonconfidential suggestions about our site or services, we may use those suggestions without compensating you. This permission does not cover your personal information, confidential business information, customer records, or materials governed by a separate agreement, and does not authorize us to use your name or business as an endorsement.
9. Third-party links and tools
The site links to and embeds third-party tools, including scheduling services. Those providers control their services, which are subject to their own terms and privacy policies. We do not guarantee their content, availability or performance. This section does not exclude responsibilities that applicable law or a separate agreement places on Fapbric.
10. Website disclaimers
The free website, its general information and its evaluation demos are provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement for those materials and features. We do not guarantee uninterrupted or error-free operation or that the site will be free from harmful components.
These disclaimers do not replace warranties or commitments in a separate service agreement, excuse fraud or misleading statements, or limit rights that applicable law does not allow us to exclude.
11. Limitation of liability
To the extent permitted by law, Fapbric will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or data, arising from use of the free website, its general information or its evaluation demos. Subject to the exceptions below, Fapbric’s total aggregate liability to you for claims arising from those uses is limited to US $100.
These limitations do not apply to fraud, willful misconduct or gross negligence by Fapbric; liability that cannot lawfully be excluded or limited; or rights and remedies that applicable law makes nonwaivable. They do not limit an obligation or liability governed by a separate service agreement. They do not waive rights under applicable privacy or consumer-protection laws that cannot lawfully be waived.
12. No waiver of legal rights
Nothing in these Terms prevents you from contacting a regulator, reporting suspected unlawful conduct, or exercising a right that applicable law does not permit you to waive. These Terms do not require arbitration or waive participation in a class action.
13. Governing law and courts
Georgia law governs these Terms, without regard to its conflict-of-law rules, except where applicable law requires otherwise.
Subject to any nonwaivable right to bring a claim elsewhere, disputes arising from these Terms or use of the site will be brought in the state courts located in Fulton County, Georgia, or the United States District Court for the Northern District of Georgia, Atlanta Division, if that court has subject-matter jurisdiction. You and Fapbric consent to personal jurisdiction and venue in those courts. This provision does not change a dispute-resolution provision in a separate service agreement.
14. Changes to these Terms
We may update these Terms prospectively. We will post the updated version and effective date on this page. For material changes affecting features for which you accepted these Terms, we will provide notice through the site or directly as appropriate and obtain renewed acceptance where required. Changes do not apply retroactively to an existing dispute or alter a separate service agreement.
15. General
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision does not waive the right to enforce it later.
These Terms govern the site and do not replace a separate service agreement or confidentiality agreement. Our Privacy Policy describes our information practices and remains applicable according to its scope. It is not a request for blanket consent to data processing.
